This is part of the theme code in the latest release so you'll need to manually copy over the new files and changes to the partial/_header & _footer. I'm working on the changes file for the release now so you can use this to see what code has changed. I'll update here when it's available.

I think this was resolved via the ticketing system. For anyone else, this was because the sql patch hadn't been applied to the database. \install\resources\upgrade_sql_statements\v4.1.1 - v4.2.sql

As enricodias4654 says, you don't need the .htaccess on Nginx, just remove it. Although I'll also add the blocking code to our Nginx rules to keep it tidy.
